These Terms of Service ("Terms") govern your access to and use of Biggymind's website and application (the "Service"). "Biggymind," "we" and "us" refer to the provider of the Service.
Contact: privacy@biggymind.com
The Service is guardian-first, by design. Every child profile ("kid profile") is created and managed by an authenticated adult guardian — a child cannot independently create their own account. You must be at least 18 years old and have the legal authority to act as a parent or guardian for any child whose profile you create, to create a guardian account.
You're responsible for keeping your account credentials confidential, and for all activity under your account, including activity by a child using a kid profile you set up for them.
Biggymind provides adaptive, TEKS-aligned academic practice across Reading, Writing, and Science — a placement assessment, practice content generated to match a child's demonstrated skill level, progress tracking, and a gamified credits/rewards system a guardian configures for their own family.
We're in beta, and we're upfront about what that means. The Service is under active development — features may change, be added, or removed. Content is generated using AI and is designed around the Texas TEKS standards for each subject offered, but is not a substitute for a licensed teacher's instruction, a formal educational assessment, or professional evaluation of any kind.
The Service is currently offered free of charge, for a beta period, to personally invited and self-registered families. No payment information is collected during this period.
If you (or a child using a profile you manage) submit content to the Service — a kid's chosen display name, a wishlist item's name and note, feedback you submit — you retain ownership of it. You grant us a license to store and use that content solely to operate the Service for your own family, consistent with our Privacy Policy.
You agree not to:
A child only ever accesses the Service through a profile a guardian creates and manages for them — see our Privacy Policy for the full detail on what information is collected about a child and how a guardian can review, correct, or delete it at any time. Guardians are responsible for supervising their own child's use of the Service.
The Service, including its design, the Biggy character and mascot system, our name and logo, and all underlying software, is owned by Biggymind and protected by applicable intellectual property laws. These Terms don't grant you any right to use our name, trademarks, or branding without our prior written permission.
You can permanently delete a child's profile and all associated data at any time, directly from your guardian dashboard — a real, complete deletion, not a soft flag (see our Privacy Policy for the technical detail). You can also stop using the Service and close your own account at any time by contacting us.
We may suspend or terminate your access to the Service if you violate these Terms, or if we discontinue the Service or a part of it. Where reasonably possible, we'll provide notice before doing so.
The Service is provided "as is," especially given its current beta status. Biggymind does not guarantee that the Service will be uninterrupted, error-free, or that AI-generated content will always be perfectly accurate or free of mistakes. Biggymind is a supplemental practice tool, not a replacement for a licensed teacher, tutor, or any professional educational or developmental assessment — if you have concerns about your child's academic development, consult a qualified educator or professional.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.
We may update these Terms from time to time. If we make a material change, we'll provide notice before it takes effect for your account.

These Terms don't yet include a limitation-of-liability or dispute-resolution section — we'd rather leave those out for now than publish invented legal language. We'll update this page once that's been worked out with counsel.
